IMPORTANT NOTICES REGARDING

Plumbers Local 98 Online Employer Remittance Website (click for notice)

Effective July 28, 2010, the option to submit an electronic check with your Fringe Benefit Report will be temporarily unavailable. Employers are encouraged to continue submitting your Fringe Benefit Reports using the Employer Web site and mail a check for payment. Simply follow the directions on the screen to print an invoice and submit your check for payment.

ATTENTION PLUMBING PAYROLL DEPARTMENTS

The July 9, 2010 issue of the Building Tradesman mistakenly states that the entire $1.95 for Local 98 Unrestricted Journeymen is to be paid to wages retro to June 7, 2010. The $1.95 is to be allocated to the fringe package as of June 7, 2010 just as it would have been if the negotiations had not taken place.

Another question which has been asked recently is in regard to Apprentice Wages and the Vacation & Holiday. The Blue “Wallet Cards” that Local 98 printed after the 2009 Allocation contained a mistake on the Apprentice Wages. Please follow the Wages and Fringes as shown on the Labor Update as the Labor Update is signed by both Labor and Management and therefore has the agreed upon allocation.

ATTENTION PAYROLL DEPARTMENTS AND EMPLOYERS WHO HIRE LOCAL 98 PLUMBERS

The negotiations with Local 98 are over. The members of Local 98 did not ratify the tentative agreement at their meeting on June 28, 2010. Due to this, the current CBA will remain in effect. The allocation of the $1.95 for Unrestricted Journeymen went into effect as of the first shift Monday morning, June 7, 2010.

The allocation approved by the membership included a wage increase which will also be effective as of the first shift Monday morning, June 7, 2010. Please calculate the amount necessary to make your Employees whole, as of this date and place it in a paycheck which they will receive by the end of the week ending July 9, 2010.

The new fringe forms which will be available online and sent out via fax and e-mail tomorrow should be used for all hours worked since the first shift Monday morning, June 7, 2010.

ATTENTION PAYROLL DEPARTMENTS AND EMPLOYERS WHO HIRE LOCAL 98 PLUMBERS

We have a Tentative Agreement with Local 98 and they have scheduled a ratification meeting for the evening of Monday, June 28, 2010 at the Plumber’s Hall.  The increase for this year is $1.95 whether the Tentative Agreement  is ratified or not.  At this time we are unable to provide the final details for the allocation of the $1.95.  We will provide full details regarding the vote of the members of Local 98, the scheduling of our own vote and the Allocation of the $1.95 by Wednesday, June 30, 2010.  Be aware that the $1.95 increase went into effect as of the first shift Monday, June 7, 2010.

STATUS OF NEGOTIATIONS WITH LOCAL 98

Both sides have worked tirelessly throughout the entire Memorial Day Weekend and late into the night last night.  At this point in time, scheduling conflicts prevent either side from meeting again for negotiations until the week of June 14.

At this time the negotiated $1.95 increase for Plumbers is NOT to be paid starting on June 7, 2010. Neither side currently foresees negotiations breaking down, but anything is always possible. If negotiations were to break down then the current contract would take effect and the $1.95 would be owed as of June 7, 2010. Please keep this in mind. It is the position of the bargaining parties that we will not let this go past the end of the month.

ATTENTION PAYROLL DEPARTMENTS

Payment of May 2010 Fringes and the new Pipefitter Wage allocation.
The rates take effect as of First Shift Monday, June 7, 2010.

2010 Pipefitters Wage Update

During this time of year when the fringe rates change, Employers are sometimes obliged to submit two sets of fringe forms for June. One set for the partial week at the beginning of June that is at the May rate and another set that is at the new fringe rate. This June will require one set for the week beginning first shift Monday, May 31 and one set for the last three weeks of June at the new allocation.

Another option to avoid two fringe forms for June. If you are able to submit ONE fringe form which covers the time period from the beginning of your May fringe report through Sunday June 6, 2010, within the normal reporting time line for fringe reports and contributions, the 15th of the month, please do so. If you need more time however:

For this one time
For hours worked in May 2010 and including hours worked through Sunday, June 6, 2010 BeneSys is willing to do what is necessary to extend the deadline of Tuesday, June 15, 2010 to Monday, June 21, 2010 for submission of fringes and reports. Please note that this extension is not available unless the hours go through June 6.

MEMO TO MCA DETROIT CONTRACTORS

Negotiations continue with Plumbers Local 98.

Please use the current wage and fringe package (June 2009-May 2010)
until you receive notification otherwise.

Labor and management continue long hours of good faith bargaining in an effort to make modifications to the agreement that will make us more competitive and increase hours.

CAUTION ! !
Be aware that should these negotiations break down, you will be liable to make up the $1.95 previously negotiated increase. The duration of this negotiation is currently limited to a maximum of three weeks into the new pay period.

We will update you again next week.

REFERENCE: ALLOCATION UPDATE FOR UA LOCALS 636 AND 98

Local 636: As many of you know, we approached 636 to give us relief on the negotiated increase to help preserve our dwindling union customer base. Local 636 has decided to deny our request.

The new pay rate will commence for all hours worked from the first shift Monday, June 7, 2010. We are currently meeting with 636 to produce this year's "Wage Update".
We hope to have it available for you by Friday of this week.

Local 98: We have entered into negotiations to modify and extend the current collective bargaining agreement with 98. If these negotiations break down the current agreement increase will stand and could be implemented as early as June 7, 2010. That is, with the first shift Monday, June 7, 2010.

We will give you an update on this Local 98 situation Friday, May 28, 2010.

REGARDING SUPERVISION WAGES
For those who received the wage update from Local 636, please be aware that the “suggested” supervision wages ARE NOT part of our Collective Bargaining Agreement.  Please note that the Labor Updates which were sent to you by our office on Monday, June 1, 2009, have both Labor and Employer signatures on them and contain ALL the rates which Employers are obligated to pay.

Please notify our office if you receive pressure in any form to pay the “suggested” supervision rates.

CONTRACTORS RATIFY TENTATIVE AGREEMENT
On Friday, July 25, 2008, the Contractors ratified the Tentative Agreement with Pipefitters Local 636.

An Employer Ratification meeting is set for Friday, July 25, 2008, 7:30 am at the MCA Detroit offices.

SHOULD the Agreement be ratified by the Contractors, the
new allocation will take effect beginning with the first shift on Monday, July 28, 2008.

The Tentative Agreement contains retroactivity back to Monday, June 30, 2008. The retroactive $1.90 raise will be paid in the Employee's check for all hours worked since the first shift on Monday, June 30, 2008.

PIPEFITTERS RATIFY TENTATIVE AGREEMENT
This morning,  Wednesday, July 23, 2008, Pipefitters Local 636 membership ratified the Tentative Agreement by an approximate margin of 6 to 1.

The Tentative Agreement is a 4 year contract calling for $1.90, $1.90, $1.95 and $2.05.

CONTRACT SETTLEMENT ANNOUNCED
As of 1:30 AM on Wednesday, July 23, 2008, the negotiation committees for Pipefitters Local 636 and MCA Detroit reached a Tentative Agreement. The Agreement has the full support of the Local 636 Negotiation Committee and will be presented to the membership of Local 636 at 8:00 AM this morning. We will be in contact soon regarding a ratification meeting for Pipefitter Employers, details on allocation, fringe forms and details of the Tentative Agreement.

The Plumbers contract agreement was ratified by MCA Detroit Contractors at a 5:00 pm meeting held July 8, 2008 at the MCA Detroit offices. The retroactive wages are due by July 17, 2008. The retroactive fringes are due by July 22, 2008.

Pipefitter negotiations continue. A negotiation meeting is scheduled for the afternoon of Wednesday, July 9, 2008, and a second meeting is scheduled for the morning of Thursday, July 10, 2008.

PLUMBING CONTRACTORS
Please provide the following notice to your Payroll department:
The agreement between MCA Detroit and Local 98 is retroactive on wages and fringes to June 2, 2008.  Due to the ratification taking place so close to the end of the month, the bargaining parties have agreed to extend the deadline for June 2008 fringes by one week. 

The new due date for June 2008 fringes is July 22, 2008.

The Employer ratification vote is scheduled for Tuesday, July 8, 2008 at 5 pm.
We are currently working with Local 98 to finalize the allocation in order to produce the Labor Updates for your payroll departments.  In the next day or two they will be finalized and we will begin sending them out via fax and e-mail, as well as posting them on our website.
Assuming the Employers ratify the agreement, the new CBA payroll should start by July 10, 2008 or at the latest, July 17, with a retro payment to June 2, 2008.  We are requesting an extension of the fringe contribution submission dead line and will notify you by Wednesday, July 2, 2008 if we are successful.

CONTRACT SETTLEMENT ANNOUNCED
At 5:15 pm, on Thursday, June 26, 2008, Labor and Management came to a contract agreement which was presented to Plumbers Local 98 Membership immediately. Within an hour, Local 98 Membership ratified a 3 year contract consisting of $1.85, $1.90, $1.95, 8 hours of training per year for each Active Member and the UA Standard of Excellence.

Local 98 has set a ratification meeting for Thursday evening, June 26th, as a result of Management and Labor negotiations that occurred on Tuesday, June 24th, in an effort to come to an agreement. MCA’s proposal was reviewed, questions were asked and both groups caucused. Local 98 came back with a proposal, presented it, questions were asked and the meeting broke up for the evening. Labor and Management will meet again today, June 25th, at 1:00 pm.

On Friday, June 6 and Monday, June 9, Local 636 and MCA met regarding the most recent proposal presented by Management. Despite the tough economic times our customers and the Michigan economy are facing, Management presented a proposal with raises equivalent to UA Local 190, other construction trades in the Detroit area and around the state of Michigan. In this market the question is “When our customers are doing everything they can to cut costs, how much of a raise are our customers willing to accept prior to looking to other alternatives?”

Management met with Local 98 representatives for four hours on Tuesday, June 10, 2008. Under discussion was industry market conditions and other contract settlements in our area. Due to Labor attending a pipe trades conference through the rest of this week, no further negotiation meetings with Local 98 have been scheduled.
